Exemption from Subsection 605.85(1) of the Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators and its flight crew members who meet the application, set out below, from the requirement in subsection 605.85(1) of the Canadian Aviation Regulations, subject to the conditions below.

This subsection prohibits a person from conducting a take off in an aircraft that has undergone maintenance without a maintenance release being signed, unless the relevant maintenance is identified in the elementary work task listings found in the Aircraft Equipment and Maintenance Standards.

Purpose

The purpose of this exemption is to permit Canadian air operators and its flight crew members to perform those task that are identified in airworthiness directive FAA AD 2003-24-01 and are within the flight crew member’s capacity to perform, but are not enumerated in the elementary work listings, set out in the Aircraft Equipment and Maintenance Standards, without requiring a maintenance release.

Application

This exemption applies to Canadian operators whose maintenance control manuals have been amended, and approved pursuant to subsection 706.08(4) of the Canadian Aviation Regulations to include those tasks that are not enumerated in the elementary work task listings, but are identified in airworthiness directive FAA AD 2003-24-01 and are tasks within the flight crew members capacity to perform.

Conditions

This exemption is subject to the following conditions:

1. The local Regional Transport Canada Office shall approve the Company training plan for the flight-crew members carrying out this inspection.
2. An inspection of the blades, in accordance with FAA AD 2003-24-01 shall be completed by an AME, during the most frequent inspection contained in the Operator Approved Maintenance Schedule.
3. Defects found during the inspection requested in airworthiness directive FAA AD 2003-24-01 shall be reported in accordance with the Canadian Aviation Regulations Part 5 subpart 91 - Service Difficulty Reporting.
4. A copy of this exemption and FAA AD 2003-24-01 shall be carried aboard the aircraft.

Validity

This exemption is in effect until the earliest of the following:

1. EDT at 11:59 on May 01, 2006

;

• the date on which any condition set out in this exemption is breached;
• the date on which an amendment made to the applicable regulatory provisions of the Canadian Aviation Regulations comes into effect; or
• the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
